These Terms of Service ("Terms") govern your access to and use of kenijeko.org (the "Site"), operated by Kenijeko Inc., a Maryland nonprofit corporation and 501(c)(3) tax-exempt organization ("Kenijeko," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
You may use the Site for lawful, personal, non-commercial purposes, including learning about Kenijeko's mission and programs, contacting us, and making donations. You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its systems; scrape, harvest, or collect data from the Site using automated means without our consent; impersonate any person or entity; or interfere with the proper functioning of the Site.
The Site, including its text, graphics, logos, the Kenijeko name and mark, and original photography and illustrations, is owned by Kenijeko or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share Site content for personal, non-commercial purposes, but you may not reproduce, modify, distribute, or create derivative works from it without our prior written consent.
Donations made through the Site are processed by Zeffy, an independent third-party donation platform, and are subject to Zeffy's own terms of service and privacy policy. All donations are voluntary. Because donations are irrevocable gifts, they are generally non-refundable once processed; however, if you believe a donation was made in error, please contact us at contact@kenijeko.org and we will review your request in good faith.
Kenijeko Inc. is recognized by the IRS as a tax-exempt 501(c)(3) organization (EIN 33-2687079). Donations may be tax-deductible to the extent allowed by applicable law; we encourage you to consult your own tax advisor regarding the deductibility of any specific donation.
Content on the Site is provided for general informational purposes about Kenijeko and its programs only. Nothing on the Site constitutes legal, financial, medical, or other professional advice, and it should not be relied upon as such.
Expressing interest in volunteering or in Kenijeko's programs through the Site does not, by itself, create any enrollment, employment, or contractual relationship with Kenijeko. Participation in any in-person program, service, or volunteer activity is subject to separate consent forms, waivers, or agreements provided to you directly by Kenijeko at the time of that participation.
The Site may link to or rely on third-party services, including our donation processor (Zeffy) and other external websites. We do not control and are not responsible for the content, policies, or practices of any third-party service or site. Your use of any third-party service is at your own risk and subject to that third party's own terms.
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is complete, accurate, or current.
To the fullest extent permitted by applicable law, Kenijeko Inc., its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Kenijeko Inc. and its directors, officers, employees, and volunteers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.
We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date, and your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
